- The Universal Periodic Review (UPR) is a process in which the human rights records of all 193 UN Member States are reviewed periodically. It was introduced when the UN Human Rights Council was created by the United Nations General Assembly Resolution 60/251 of 15 March 2006, and it was adopted unanimously by all UN Member States. Under this process, the human rights situation of all member countries of the UN is reviewed every 4.5 years.
- The UPR is a State-driven process. Each State is given an opportunity to declare what actions have been taken to improve the human rights situation in a country and to fulfil their respective human rights obligations. The UPR is designed to ensure equal treatment for every country when their human rights situations are assessed. The ultimate aim of this mechanism is to improve the human rights situation in all countries and address human rights violations wherever they occur.
- The Review of a country is conducted by the UPR Working Group which consists of the 47-members of the Human Rights Council. However, any UN Member State which is not a member of the 47-member Human Rights Council at a given time can also take part in the discussion/dialogue with the States that are under review. Civil Society Organizations and National Human Rights Institutions can also participate at the Review.
- The following 3 documents are used by the Working Group for the Review:
- information provided by the State under review, which can take the form of a “national report”;
- information contained in the reports of independent human rights experts and groups, known asSpecial Procedures, human rights treaty bodies, and other UN entities;
- information from other stakeholders including national human rights institutions and non-governmental organizations.
- Following the review by the Working Group, a report referred to as the “outcome report” consisting of the questions, comments and recommendations made by States to the country under review, as well as the responses by the reviewed State, is prepared and adopted. The reviewed State has the opportunity to make preliminary comments on the recommendations choosing to either accept or note them. Both accepted and noted recommendations are included in the report. The report is then adopted at a plenary session of the Human Rights Council. Time is also allotted at the plenary, to member and observer States who may wish to express their opinion on the outcome of the review, and for National Human Rights Institutes, Civil Society Organizations and other stakeholders to make general comments.
- So far, since its inception, Sri Lanka has been reviewed twice under the UPR, in 2008 and 2012 respectively. Sri Lanka’s 3rd UPR is scheduled for November 2017 and the national report in this regard has to be submitted to the UN Human Rights Council in Geneva on or before 7 August 2017.
- The Ministry of Foreign Affairs, in consultation with the relevant line Ministries, Departments and Agencies, has prepared a draft national report and invites all interested individuals and Civil Society Organizations to share with the Ministry, their respective views and observations on the draft.

මානව හිමිකම් පිළිබඳ කාලාන්තරීය විශ්ව සමාලෝචනය (Universal Periodic Review) සඳහා වන ශ්‍රී ලංකා ජාතික වාර්තා කෙටුම්පත ගැන අදහස් විමසීම
- මානව හිමිකම් පිළිබඳ කාලාන්තරීය විශ්ව සමාලෝචනය යනු එක්සත් ජාතීන්ගේ සාමාජික රටවල් 193හි මානව හිමිකම් තත්ත්වය කාලාන්තරව සමාලෝචනයට ලක්කරන ක්‍රියාවලියකි. මේ ක්‍රියාවලිය හඳුන්වාදෙන ලද්දේ එක්සත් ජාතීන්ගේ සංවිධානයේ සියලු සාමාජිකයන් විසින් 2006 මාර්තු 15 වන දින ඒකමතිකව සම්මත කරගනු ලැබූ මහා මණ්ඩල අභියෝජනා (resolution) අංක 60/251 මගින් එක්සත් ජාතීන්ගේ මානව හිමිකම් කවුන්සිලය ස්ථාපිත කරන අවස්ථාවේදීමය. මේ ක්‍රියාවලිය යටතේ එක්සත් ජාතීන්ගේ සාමාජික රටවල් සියල්ලෙහිම මානව හිමිකම් තත්ත්වය වසර 4.5 කට වරක් සමාලෝචනය කරනු ලැබේ.
- කාලාන්තරීය විශ්ව සමාලෝචනය රාජ්‍යයන් විසින් මෙහෙයවෙන ක්‍රියාවලියකි. මෙහිදී එක් එක් රාජ්‍යයට, සිය රට තුළ මානව අයිතිවාසිකම් තත්ත්වය වැඩි දියුණු කිරීම සඳහා සහ මානව හිමිකම් වගකීම් ඉටු කිරීමට තම රජය ගෙන ඇති පියවර විස්තර කිරීමට අවස්ථාවක් සැලසී ඇත. කාලාන්තරීය විශ්ව සමාලෝචනය සැලසුම් කරනු ලැබ ඇත්තේ එක් එක් රාජ්‍යයෙහි මානව හිමිකම් තත්ත්වය සමාලෝචනය කරන අවස්ථාවේදී සියලුම රටවල් සමාන සැලකීමට භාජනය වන බව තහවුරු වන පරිද්දෙනි. මෙම යාන්ත්‍රණයේ අවසන් අරමුණ සියලුම රටවල්වල මානව හිමිකම් තත්ත්වය වැඩිදියුණු කිරීම සහ මානව හිමිකම් උල්ලංඝනය කිරීම් පිළිබඳව කටයුතු කිරීමයි.
- මෙම සමාලෝචනය, මානව හිමිකම් කවුන්සිලයේ සාමාජික රටවල් 47න් සමන්විතවන ක්‍රියාකාරී කණ්ඩායමක් විසින් සිදුකරනු ලැබේ. එහෙත් මානව හිමිකම් කවුන්සිලයේ සාමාජික රටවල් 47ට අයත් නොවන එක්සත් ජාතීන්ගේ සංවිධානයේඅනිකුත් සාමාජික රටවල්වලටද සමාලෝචන සැසිවාරයන්ට සහභාගී වී සමාලෝචනය කෙරෙන රාජ්‍යයේ නියෝජිත පිරිස සමග අදහස් හුවමාරු කරගත හැකිය. එමෙන්ම සිවිල් සංවිධාන සහ ජාතික මානව හිමිකම් කොමිසම් වලටද සමාලෝචනය සැසිවාරයන්ට සහභාගී විය හැකිය.
- සමාලෝචනය සඳහා ප්‍රධාන වශයෙන් පහත සඳහන් ලියැවිලි තුන (3) උපයෝගී කරගනු ලැබේ.
- සමාලෝචනයට ලක්වන රාජ්‍යය විසින් ඉදිරිපත් කරනු ලබන එම රටෙහි මානව හිමිකම් තත්ත්වය පිළිබඳ ජාතික වාර්තාව
- එක්සත් ජාතීන්ගේ සංවිධානය විසින් පිළියෙළ කරන වාර්තාව
- සිවිල් සංවිධාන හා ජාතික මානව හිමිකම් කොමිසම් විසින් ඉදිරිපත් කරන වාර්තාවල අඩංගු කරුණු වල සම්පිණ්ඩනයක්
- සමාලෝචනය අවසානයේදී සමාලෝචනයට ලක්වන රට වෙත ඉදිරිපත් කෙරෙන ප්‍රශ්න, අදහස්, නිර්දේශ මෙන්ම සමාලෝචනයට ලක් කෙරෙන රට සපයන පිළිතුරු හා එහිදී සිදුකෙරෙන සාකච්ඡාවේ සාරාංශයක් අඩංගු මුලික වාර්තාවක් පිළියෙළ කර ක්‍රියාකාරී කණ්ඩායමේදී සභා සම්මත කර ගනු ලැබේ. මෙහිදී සමාලෝචනයට ලක්වන රටට, සියරට වෙත කෙරෙන නිර්දේශ පිළිගනිමින් හෝ ඒවා සැලකිල්ලට ලක් කරමින් ඒ පිළිබඳව මුලික අදහස් දැක්වීමක් කළ හැකිය. සමාලෝචනයට ලක් කෙරෙන රට විසින් පිළිගනු ලබන නිර්දේශ මෙන්ම සැලකිල්ලට ලක් කරන නිර්දේශ මෙම වාර්තාවට ඇතුලත් වේ. මෙම වාර්තාව නිල වශයෙන් සම්මත කර ගැනීම පසුව එළඹෙන මානව හිමිකම් කොමිසමේ මහා සැසි වාරයකදී සිදුකරනු ලැබේ. මේ අවස්ථාවේදීද එක්සත් ජාතීන්ගේ සාමාජික හා නිරීක්ෂණ රාජ්‍යයන්ට සමලොචන ක්‍රියාවලිය ගැන අදහස් දැක්වීමට කාලය වෙන්කරනු ලැබේ. සිවිල් සංවිධාන සහ ජාතික මානව හිමිකම් කොමිසම් වලටද මේ අවස්ථාවේදී වාචිකව අදහස් දැක්වීමට හැකිය.
- මේ දක්වා ශ්‍රී ලංකාව වර්ෂ 2008 දී සහ 2012දී වශයෙන් දෙවරක් කාලාන්තරීය විශ්ව සමාලෝචනයට ලක් කෙරී ඇත. ශ්‍රී ලංකාවේ තුන්වන කාලාන්තරීය විශ්ව සමාලෝචනය මේ වසරේ නොවැම්බර් මාසයේ සිදුකෙරෙන අතර ඒ සඳහා වන ජාතික වාර්තාව 2017 අගෝස්තු 7 වන දින හෝ ඊට පෙර ජිනීවාහි මානව හිමිකම් කවුන්සිලයට ඉදිරිපත් කළ යුතුය.
- මේ අනුව අදාළ සියලුම අමාත්‍යංශ, දෙපාර්තමේන්තු හා රජයේ ආයතන වලින් තොරතුරු ලබාගැනීමෙන් පසුව විදේශ කටයුතු අමාත්‍යාංශය විසින් ජාතික වාර්තාවේ කෙටුම්පතක් පිළියෙළ කර ඇති අතර එම වාර්තාව ගැන මේ පිළිබඳව උනන්දුවක් දක්වන සිවිල් සංවිධාන සහ මහජනතාවගේ අදහස් විමසීමට අපේක්ෂා කෙරේ.
- ඉංග්‍රීසි බසින් ඇති මේ වාර්තා කෙටුම්පත, එහි නිල නොවන සිංහල හා දෙමළ පරිවර්තන සමග විදේශ කටයුතු අමාත්‍යංශ වෙබ් අඩවියෙන් බාගත හැකිය.
- මේ වාර්තාව පිළිබඳව අදහස් දැක්වීමට කැමැති අයෙක් හෝ සංවිධාන වෙතොත් එම අදහස් සිංහල, දෙමළ හෝ ඉංග්‍රීසි බසින් ලිඛිතව 2017 ජුලි 15 වනදාට පෙර තැපෑලෙන්, ඊමේල් හෝ ෆැක්ස් මගින් එවන ලෙස ඉල්ලා සිටිනු ලැබේ:
